Terms of Service

Transparent and fair rules for using the DonationPay platform. By registering your charity, you agree to these terms.

1. The Service

DonationPay is a digital giving platform operated by Code Smart Web Limited. Our service provides Charities with tools to collect digital donations via QR codes, manage multilingual donor interfaces, and generate Gift Aid reports.

2. Fees and Payments

DonationPay operates on a "pay-as-you-go" model. There are no setup or monthly subscription fees.

  • Platform Fee: We charge a 2.0% platform fee per transaction.
  • Processing Fees: Third-party payment processing fees (Stripe) apply separately at their standard rates.
  • Deduction: All fees are automatically deducted from the donation before it reaches the Charity bank account.

3. Fund Handling

DonationPay uses Stripe Connect to facilitate payments. We never hold your funds. Money flows directly from the donor to the Charity’s Stripe account and is subsequently transferred to the Charity’s bank account. Charities must comply with Stripe's Terms of Service to use our platform.

4. Gift Aid Responsibility

While DonationPay provides reports to assist in Gift Aid claims, the Charity remains the "Charity" in the eyes of HMRC. The Charity is solely responsible for:

  • Verifying the accuracy of the Gift Aid claims submitted to HMRC.
  • Ensuring they have a valid Gift Aid registration with the UK government.
  • Maintaining records as required by HMRC.

5. Multilingual Support

Our platform provides interfaces in both English and Polish. While we strive for perfect translation, the Charity should review any localized content provided to their supporters.

6. Limitation of Liability

Code Smart Web Limited shall not be liable for any indirect, incidental, or consequential damages arising out of the use of the service. We do not guarantee uninterrupted service, though we maintain a 99.9% uptime goal.

7. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
